Privacy Policy (Part A.) of Pixel Talents ("Pixel Talents") for the Use of Pixel Talents-Websites and Declaration of Consent (Part B.)

This privacy statement provides general information about the treatment of personal data by Pixel Talents for usage at www.PixelTalents.com. It contains a description of data processing operations that are required for the provision of services on the Platform.

A. Information on Privacy Policy

Pixel Talents provides the opportunity for creative artists and users to come together. Visitors can have their photos edited and/or artistically enhanced by digital artists, and can print them directly as a poster, on canvas or with other media. Graphic designers can offer their services over the Platform within a given framework. Pixel Talents offers users a technical online infrastructure to use for this purpose ("Services"). Pixel Talents attaches great importance to the sensitive and responsible handling of personal data (all the personal or factual information) provided by users of the Platform ("User"). Use of the Platform requires that users create an account. Some data that users divulge over the Platform (in particular during the registration and payment processing), may be personal data. Pixel Talents collects, processes, and uses personal data of the User for the purpose of the provision of services.

With this privacy policy, Pixel Talents would like to inform the User about the utilization of personal information. The privacy policy applies to all services provided by the Platform. We appreciate your confidence in using the Platform with respect to data processing. Your legitimate expectations of compliance with security standards, maintenance of obligations to inform, and responsible handling of your personal data will be met by Pixel Talents in particular by the following:

1. Pixel Talents undertakes to obey the legal provisions on data protection, in particular the Bundesdatenschutzgesetz (BDSG) and the data protection provisions of the TeleMedia Act (TMG).
2. Pixel Talents will collect, edit and use personal data only in the context of the provision of services. Pixel Talents will not give to third parties, sell or otherwise make available personal information without consent of the user, unless Pixel Talents is obliged to such disclosure for legal reasons (e.g. by law or judgment or to track illegal, especially fraudulent, acts of the user) or to assert a claim (for example to contract performance).
3. Within the registry, personal information may be retrieved by the User for purposes of processing orders. So you have an idea what kind of data is there, we have compiled the essential categories:

3.1 Necessary Registration Information

In order to register to use the services, the User will provide personal information such as given name, surname, street, postal code, city, country, and e-mail address, VAT registration number, a password and the user name. Required information is marked with a (*). Pixel Talents needs this registry data to create user accounts, as well as to manage, edit and settle purchase orders.

3.2 Optional Information

As far as the Platform allows the User to specify other personal data (such as private or professional information about training, skill, company etc.) next to the necessary registry information, users should note that revealing this information is voluntary and for instance, can serve as mutual understanding and the exchange of information, and that this information is visible to all other users and the public. You may be found through search engines on the Internet.

3.3 Information on payment processing

As far as the customer will enter payment information such as credit card number by ordering, this data will be used only for payment processing as needed

4. Data Transmission to Contracting Parties

   To the extent that the User, as a customer or graphic artist close contracts over the Platform which then are handled by the applications of the Platform, Pixel Talents will post the respective personal information of the parties to the contract for proper processing of the transaction. So the customer, for instance, will be provided on request with the name and address of the artist, should any rescinding of the transaction may become necessary. The artist will also be provided with address information for the User, for settlement of any monetary claims in accordance with the customer's purchase order.

5. With regard to links to advertisers' websites contained on the Platform, Pixel Talents has no influence on the collection, processing and use of information by these advertisers. Pixel Talents undertakes no responsibility for them.
6. Pixel Talents feels an obligation to protect the security of the User's information, and has taken specific measures to protect that information. Nevertheless, Pixel Talents does not accept responsibility or liability for disclosure of user data due to errors in data transmission or unauthorized access by third parties.
7. The user can request information at the above contact address about his stored information at any time, free of charge.

B. Declaration of Consent

By accepting this 'Declaration of Consent' the user agrees to the following usage of his data. The user can revoke this any time per mail (Pixel Talents GmbH, c/o LMU EC, Geschwister-Scholl-Platz 1, 80539 Munich) or per e-Mail at kontakt@pixeltalents.com. The user will accept Part A (above) and declare following:

1. Google Analytics, Cookies, Log Files:

   I agree, that Pixel Talents uses cookies and Log Files on its websites. With the help of cookies, usage information is collected, processed and used in order to allow the User to control the different services on the Platform as well as manage his individual user account. Cookies are text files that are either temporarily stored in the user's computer memory or stored on his hard drive. They generally offer personal service to the User with each session. Cookies are partially permanently stored on the hard disk of the user. The user can prevent this by changing the settings in the browser. Every page call logs access data of the user to a file - the so-called log file. It stores information like IP address, the remote host, the time, the status, the transferred amount of data and the website of the user who has retrieved the requested page, and product and version information of the user's browser. This data is for statistical purposes, to create anonymous user profiles and to serve refining and marketing purposes. The user can always refuse to allow this process.

   This website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States . Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf.    All the methods mentioned will NOT be used to collect any data of the user without his consent and will be not be given or sold to third parties

2. Transmission to contracting party of the user

   I agree, that Pixel Talents will tranfer my personal data to my contracting parties with whom I enter into a contract on Pixel Talents (i.e Customers, Service Provider as well as Payment Companies).

   I agree, that Pixel Talents will make my username, feedback and user-rating available to all users of the plattform
